This informal joint meeting was held to review the Corps o£ Engineers Vermillion
River Flood Project.

MINUTES OF SPECIAL MEETING OF CITY COUNCIL, PLANNING COMMISSION
AND NATURAL RESOURCES HELD MONDAY, MARCH Z7, 1972
The following is the report for the Planning Commission Meeting held Monday, March 27,
jointly with the Hastings City Council, Hastings Natural Rsources Commission, any
interested citizens. The discussion being the Flood Control Project for the Vermillion
River between the Peavey Mill Dam and County 47 Highway Bridge.
Those present: Donald J. Fluegel, Pamela F. Thomas, Dave Pederson, Waiter H.
Thomas, Mavis M. Nelson, Walter Bauer, Evarist J. Rotty, Lyle Steffenson, A1Rotty,
Steven Gartzke, Junior Member, Steve Willeke, Junior Member, Jim Wright, George
Skene, Robert F. Post, Raymond Solac.
Hastings Planning Commission members present were Mr. Trautmann, Mr. Sieckert,
Mr. Soleim, Mr. Hallbeag,Mr. Tanner, Mrs. Linde, Mr. Wilson, and Junior Members
Mr. Gartzke, Mr. Willeke.
Making the presentation was Mr. Jim Wright from the Department of Natural Resources
and Mr. George Skene and Robert F. Post from the Corp. of Engineers.
There was a presentation by Mr. Dave Pederson from the Natural Resources Commission
in regard to what aspects of the plan the Natural Resources Commission is reviewed to
date. He understood that there would be recreation funds available under Public Law 897Z
in the development where the City would pay 50 %, the Corp. of Engineers 50% c~ the
development cost for any recreation program included in the Flood Control Project. It
would be their recommendation he stated to include the Natural Resources recommendation
in the Flood Control Project to create a river corridor rather than a straight ditch and
recommend additional land acquisition for that aspect of the problem. Mr. George Skene
reviewed the bypass channel concept for a green floodway South of and parallel to the
existing river channel. He stated that one of the aspects of the project is that it is still
not completed solidified as the Dam replacement where there would be 50-50 funds required
for replacing the man made portion of the Dam on the existing rock falls with a shear gate
type Dam at a estimated cost of $Z50,000 for a City share of $1g5,000. This $1Z5,000 with
the City's land acquisition cost estimated at $90, 000 would make the City's st~re approximate
$215,000 of the Flood Control Project, another $200,000 was added for recreation projects.
The City's share would be approximately $315,000. Mr. Skene stated also that no other
Federal funds can be used to acquire lands for this project with the 40 acre parcel for the
Flood Control Project would have to be furnished by the City either on an easement basis
or by land acquisition basis. We have the cost of the land to be acquired in the Flood Plain
at $1,000 per acre. There is a question as to how realistic this figure was. The Corp.
is now waiting for direction from the City. The City would have to provide assurances
that they would proceed with the proposed project and enter into a contract agreement with
the Corp. of Engineers at an early date so that they can complete the project. Mr. Jim
Wright then answered some questions in regard to the Flood Plain study. Mr. Wright

study nnce the Corp. of Engineers Flood Control Project was completed to show that the

area presently included in the 100 year flood frequency. The area would be removed
by the Construction Program. Mr. Skene then also stated that the Corp. of Engineer
was assuming that disposal of the spoil from the revised channel would be located at
another site that we would not need additional lands for stock piling the spoil from
this project. There were several things the Corp. of Engineers wanted answered
as follows:
1. Will the City give assurance that they will follow through with the project.
Does the City want the Dam if they pay 1/Z of the cost.
3. Would they enter into contract agreement with the Corp. of Engineer assuring
the completion of the project and taking charge of the maintenance and upkeep
upon completion and construction.
4. Would there be any recreation project included with the Flood Control Project
or if staged what would be the normal staging.
The Committee then discussed the least necessary amount of land acquisition required
whic]% would be just the green way for reconstruction and the "Hold Harmless" clause
to the Corp. of Engineers. It was suggested that this property might be acquired at
no cost to the City as a consideration for construction in an area presently in the
Flood Plain South of the river if that area South of the river were in fact protected
by the revised drainage course.
There were some questions in regard to the availability funds. Mr. Wright
stated that that was not his area of concern. That the Department of Local and Urban
Affairs was now handling all of these fund grants. Then a suggestion by Chairman
Peterson that Mr. Dave Pederson and Wally Erickson and John Davidson make a study
of land acquisition and finances. Mr. Skene furnished the City Attorney, Mr. Fluegel
with a copy of the Flood Plain agreement. (Try to acquire a copy of this from the
City Attorney).
There was then a motion by Mr. Hallberg suggesting the proposal of Mr. Peterson
that the Committee of Pederson, Erickson and Davidson be appointed for informational
study and that they be given guide lines at the regular Council Meeting April 3.
Next there were some questions from the floor by a resident, Z06 East 3rd asking
what the zoning was on her property and what if anything was proposed in the Downtown
Redevelopment as far as her residential property was concerned. She was told that
the County in their development of a new Courthouse site on Highway 55 would probably
not be making use of the balance of Block 19 Original Town Hastings in which her home
is situated. She would therefore would not be in any position of pressured into a different
use without her property being purchased on the open market or being relocated under
Laws, Rules and Regulations governing acquisition of land under the legal condemna-
tion proceedings. In her case it would have to be in the total urban renewal program for
the Downtown Development. At this point there is no such organization in existance.
At 8:30 PM was the regular Planning Commission convened. Mr. Walt Peterson
received two page 1 copies of the previous minutes and no page Z. I furnished him my
copy of the minutes. (Make sure I have a copy of the Planning Commission Minutes of
March 13 in my file). Mr. Peterson went through the last Agenda, touched on Dakota
Hills Second Addition Townhouse Development, Mr. Haas, Parking proposal, the
refacing of the Finch Building, the water tan!{ storage, the Aaron proposal for

Home Occupation. Request from Bill Chaney for a garage setback. Mr. Frank
Sieckert indicated that they would have a decision at the next Planning Commission
Meeting of April 10. Then discussed the review of the subdivision regulations.
He stated that we should take that under advisement for the next regular meeting.
The next regular meeting would be established for April 10.
Next a proposal from Mr. Elmer Peterson for building permit for a single family
residence in an agricultural zone on County Road 91 North of the K!uender property
be allowed a building permit on a 2 acre parcel. The request was turned over to
Mr. Wilson's committee and Mr. Wilson's committee was to make a policy state-
ment in regard to density of development in marginal flood plain areas and possible
recommendations for minimum lot sizes where sewer and water availability are
remote.
The engineer read a letter from Dwayne Kasma with T.K.D.A. indicating that
the $3000 cost estimate for preparing the Capital Improvements Program was
nearing completion and that we should consider the balance of the work and what
additional funds may be required to complete the study. (See copy of letter
attached)
There was a request referred from the City Council to rezone the Court House
site located on the S 1/2 of the NW 1/4 of Section 29, Tl15 R17 according to
Section 3.5 - Essential Services of the Zoning Ordinance, any County properties
would be exempt from the Zoning Ordinance. It was moved by Mr. Sieckert,
seconded by Mr. Trautmann and unanimously passed recommending to the Council
that the area be not rezoned, that the Court House construction be allowed under
Section 3. 5 of the Zoning Ordinance.
There was a referral from the Council of the William Bob[ken proposal to locate
a trailer - mobile home, on a site in South Hastings adjacent to Cannon Street
where the existing footing, foundation and skirting was in place from a trailer
that was removed last Fall and Mr. Bohlken would like to replace that trailer
with a better insulated trailer. It was moved by Mr. Hallberg, seconded by
Mr. Soleim and unanimously passed recommending that the mobile home be altowed
only for the period of time that Mr. William Bohlken personally lives in the trailer.
There was a referral from Mr. Don Fluegelfor a Fluegel-Kugler plat in the area
of Southview Drive and Louis Lane. This will be discussed at the next meeting
and referred legally to the Council on April 3, 1972.
The teen members of the Planning Commission indicated that they had a Community
Center Study to present to the Planning Commission, however, unfortunately,
Mr. Leo Schumacher, Jr. was not able to make the meeting and he had the study
available. They will present it at the next meeting of April 10, 197Z.
We completed our Planning Commission Meeting at approximately 10:00 P.M.
