Those present: Mr. Walt Petersen, Mr. Dave Tanner, Mr. Don Hallberg, Mr. Frank Sieckert, Mr. Clarence Soleim, Mr. Pat Wilson, Mr. Fred Trautmann. Also present: Chamber of Commerce Secretary, Mr. Dennis Pellant, Mr. Lew Jacquis from the Mississippi Valley Star, and Mr. John Davidson, City Engineer. It was moved by Mr. Sieckert, seconded by Mr. Hallberg and unanimously passed to accept the minutes of January 10, 1972 as written. There was a discussion on the sign ordinance amendments. We reviewed this with l~r. Pellant who was on the ad hoc committee studying the sign ordinance and recommending changes. (See copy of suggested amendments attached). Section 7. 3. 18 was suggested to be reviewed by the City Attorney with a re-write if necessary. Under Section 7.3.7. 1, remove the following: "Names of occupants of premises or other identification of premises" It was moved by Councilman Wilson, seconded by Councilman Hallberg and unanimously passed suggesting the amendment to Section 7. 3. 7. 1. It was moved by Mr. Tanner, seconded by Mr. Sieckert and unanimously passed to recommend the entire amendment as written, plus the amendment of 7.3.7. I to the City Council and to be reviewed by the City Attorney prior to recommendation to the Council. (Make up copies of the proposed amend- ments for distribution to the City Council with the mailing of the agenda for the February 7th meeting). The next item of discussion was the sign ordinance violation by Mr. Schmitz. His home occupation requires a sign no larger than 2 square feet. The Home Occupation Section of the ordinance requires only one, however, the Planning Commission would be in agreement with a double-faced sign of no larger than 2 square feet. Ail other signs would have to be removed, because of the zoning. (Make a note to send a letter to Mr. Schrnitz citing that section of the Sign Ordinance and follow through if he does not comply). Councilman Wilson gave a report on Home Occupations. (See amended report attached). It was moved by Councilman Hallberg, seconded by Mr. Soleim to recommend the amendment to the City Council and to be mailed out with the agenda for the February 7th Council lV~eeting. (Cut a stencil for mailing). Minutes of Hastings Planning Commission Meeting held Monday, January 24, 1972 Page 2. Whe Engineer read a letter from Beltz Realty stating that property at 1266 W. 8th Street (Kongsgaard property) be used for a gift shop and that a sign variance be granted to allow the ox~ners to place a 3' x 4' double-faced sign on the premises. The Engineer stated that he wanted to bring this to the attention of the Planning Commission because we had been discussing home occupations. It was determined by the Planning Commission that this is an allowed use in an R-3 Zone, would not require a Special Use and that the sign ordinance should be interpreted to be a double-faced sign in accordance with his request. Under that section of the sign ordinance he would be allowed 1Z square feet of sign, provided it is set back fifteen (15) feet from the roadway. (See copy of letter of request attached). There was a report by Mr. Wilson regarding the Rother Body Shop request for a building permit to increase the size of the old Livingston Ford building for auto body repair structure. The committee recommended that the building permit be denied on the basis of failure to meet rear yard setback requirements of 10 foot minimum. It was moved by Mr. Trautmann, accepting the recommend- ation of the committee based upon Section 6. 1, page 1Z of the Zoning Ordinance to ndzincrease anon-conformity. It was also suggested that a Special Use should be granted for the use as a body shop. (Check with Matula, Larson and Legler to see when the body shop started the operation at this location). See if it was a pre-existing use or if it started after the Zoning Ordinance was in affect and require them to secure a Special Use if in fact, the use w[li continue. The motion was then set to read: "In accordance with the following requirements: 1. Setback 2. Not to encourage non-conformity in accordance with Section 6. 1 3. That a Special Use permit had not been applied for in the first instance as grounds for denial. This was unanimously passed. The next item of discussion was the Planning Commission's coordination between the Townshipsand City of Hastings through the Planning Commission. The Planning Commission of Marshan will meet with the City Planning Commission next Monday, January 31, 1972 at 7:30 P.M. to discuss expanded services. (Make a note and notify the Planning Commission of that meeting). It was pointed out by Mr. Petersen that Mr. Wilson had volunteered his study committee for the/iaison group, but Mr. Petersen thought the whole Planning Commission should be involved in the discussions at the next meeting. Also, Mr. Harry Schoen should be notified of this meeting to be present on behalf of Marshan Townboard Planning Commission. It was also pointed out that the City Clerk was securing the professional services of Mr. Louis Claeson, attorney for the Metropolitan League of Municipalities. The next item of discussion was a suggestion by Mr. Hallberg that a joint powers alternative be discussed in the interim as a joint planning commission and if annexation was not in yet it would at least be in the long-range program. Mr. l~etersen indicated that the Charter Commission would meet on Tuesday, February 8, 1972 to discuss finance sections of the City Charter. Anyone .interested should be [n attendance at that meeting. There was a review of the final plat of Mr. Don Fluegel and Dr. Kugler. The original review had been made on April 12, 1971 which stated, we would require cash payment in lieu of park land and no building within 150 feet of the metes and bounds property line along the Vermillion River, and dedication of the 30 foot half right-of-way of street adjacent to the plant on the north line. We then got .into a discussion of what is the 5% l~%~ee' of the land; is it raw land or platted value. It was moved by Mr. Trautmann, /~econ~ead to secure approval. It was suggested the review be delayed until the 5% value of the land be determined and find out if the 5% value had been secured in the case of the small plat on Sun Valley Drive, and Louis Lane, and in fact if that plat had been filed. DEFINITION - Home Occupations (Page 4) The use of the dwelling unit for the home occupation shall be clearly incidental and subordinate to its use for residential purposes by its occupants and not more than 25 per cent of the floor area of the dwelling unit (add) including basement shall be used in the conduct of the home occupation. There shall be no chanqe in the outside appearance of the buildin~ or premises, or other visible evidence of the conduct of such home occupation other than one~ ~ non-illuminated ...... ~ ......
