Those present: Mr. Walt Petersen, Mr. Frank Sieckert, Mr. Dave Tanner, Mr. Skip Soleim, Mr. Don Hallberg, Mr. Arlie Siebrecht, Mr. Pat Wilson, Mrs. Marcella Linde and Mr. Fred Trautmann Also present: Student Members: Mr. Steve Willeke, Senior Class Representative, Mr. Steve Gartzke, Junior Class Representative, and Mr. Leo Schumacher, Jr., Sophmore Class Representative, members of the press, Councilman Jack Christenson, and City Engineer John Dav~dson. It was moved by Mr. Sieckert, seconded by Mrs. Linde to accept the minutes of October 11, 1971. Councilman Jack Christenson appeared before the Planning Commission in regard to the Capitol Improvements Program under the implementation of the Comprehensive Plan. He commended the Planning Commission for the fine work that they have done in establishing the Comprehensive Plan and establishing the implementation thereof. He was speaking as a Councilman on behalf of the Safety Committee and stated that there was a lack of office space for the City Hall and all of the working departments, that there was an alternate request for space improvement to be presented by him to the Planning Commission for consideration which would be a joint Police-Fire Station and accomplished by constructing a second story over the present Fire Department Offices, that the Fire and Police needs should be projected to include a full-time dispatcher for both departments. He also stated that the City Operation forces needed a garage facility, that there was a considerable amount of outside storage for both winter and summer of City equipment. He would also be looking at the Planning Commission for recommendation for location of that facility. He stated that he could foresee a combined Police and Fire Department called the Department of Public Safety in the future and a combined Street, Park and Water Department known as a combined Public Works Department in the future. Mr. Christenson had a conflicting meeting and had to leave early. The four-man committee established for a thoro~g_l~.are and traffic study as a subcommittee to the Planning Commission~e~st-~blii~d'were present. They are Mr. Wally Swanson, Mr. Ron Hoffman, Mr. Larry McNamara and Mr. Douglas Differt. The City Engineer introduced the four men to the Planning Commission and briefly reviewed the traffic study problems confronting the Planning Commission and the committee specifically in certain areas. Mr. Wait Petersen read a letter from the Youth Commission at Richfield, Minnesota pointing out the need and utilization of the youth program in Richfield. The Engineer stated that he had on three occasions had request for garages within 30" of the size lot line and asked the Planning Commission if the committee had made recommendation in regard to the conflict between the 30" and the 5 foot side-yard requirement written into the Zoning Ordinance. Mr. Frank Sieckert, Chairman of that committee stated that they had not taken final action, but would be taking action at the next Planning Commission Meeting. There was a brief report in regard to the Frontage Road system. The chairman of that committee was Mr. Pat Wilson. The Engineer stated that the Meters had furnished the City with a front foot cost for acquisition of right-of-way and that Mr. Dennis Held had indicated that he had finalized his request. The only one not submitting a cost analysis to the City was Star Realty or Groth Insurance Agency. The Mobile Home Committee consisting of Mrs. Linde, Mr. Sieckert, Mr. Hallberg, and Mr. Wilson has not taken any action on any of the pending requests. The Home Occupation Committee under the direction of Mr. Siebrecht furnished the Planning Commis sion in outline fo rm fo r conside ration and recommendation back at the next regular meeting. (See copy of Home Occupation recommendations attached. ) Mr. Petersen reviewed the committees of the Planning Commission. The first committee would be headed by Mr. Wilson and it would be Mr. Wilson, Mr. Soleim, Mr. Tanner and Steve Gartzke. The second committee under the chairmanship of Mr. Sieckert would be Mr. Sieckert, Mr. Hallberg, Mrs. Linde and Steve Willeke. The third committee under the chairmanship of Mr. Trautmann would be Mr. Traut- mann, Mr. Petersen, Mr. Siebrecht and Leo Schumacher, Jr. The committee studying the Petersen-Bauer request for building permit had no report. The Flood Plain Study, as indicated by the City Engineer, had been promised to us by Mr. Jim Wright of the Natural Resources Commission on Monday, November 15th and would be presented formally to the City Council, however this has not been confirmed. We then did a full review of the Home Occupations Section of the Zoning Ordinance. There was an amendment to Paragraph 3, eliminating the last part of the last sentence, placing the period after sign, and inserting before sign, "non-illuminating" (see copy of Home Occupations Section with corrections as shown. ) It was moved and seconded to omit definition 5 entirely. To check Paragraph 6 with DonFluegel. Under Paragraph 4, add "except garage". It was then suggested that this be placed on the agenda for the next meeting and check with Minutes of Hastlngs Planning Commission Meet,ing held Monday, November 8, 1971 Page 3. Don Fluegel in regard to the problem on Zlst and Louis Lane with the Dancing School and glst Street with the ceramics classes. Mr. Petersen read a letter from the Chamber of Commerce outlining the questionnaire in regard to the Comprehensive Plan. It was then suggested by Pat Wilson that he meet with the City Engineer and review all of the data for the facilities section of the Capitol Improvements Program prior to the meeting of November 22, 1971. I was then asked to make copies and furnish each member a copy of the Planned Unit Development Ordinance recommended by the Metropolitan Council. {This was done.) Mr. Petersen then suggested that we discuss value engineering, i.e. brainstorming, as one method of planning under the Planning Commission jurisdiction. A letter was read, together with the preliminary plat, from Ben Sontag for Sontag's 2nd Addition. (See copy of letter attached. ) Also notify Mr. Sontag that he can proceed with the final plat to be presented to the City Council. This is in accordance with Planning Commission recommendations. It was also suggested that I mail a copy of the Comprehensive Plan to Mr. Bill Merritt, District 9 Highway Department Engineer. In the case of electrical interference, no equipment or process shall be used which creates visual or audible interference in any radio or tele- vision receivers off the premises, or causes fluctuation in line voltage off the premises. Where Permitted: Section 9.3 "R-i" LOW DENSITY RESIDENCE Section 9.3.1 INTENT - the intent of this Ordinance in establishing a low density residence district is to provide for the normal outward residential expansion of Hastings according to current standards of development, and to protect the desired quiet' living environment from encroachment from potential conflicting uses. Section 9.3.2 Uses Permitted: Section 9.3.2.4 Customary home occupations provided that safe off- street parking facilities are provided and the following: Section 9.3.2.4.1 Not more than 25 per cent (25%) of the gross floor area of the residence is used for this purpose. $ ¢ i0n ,3,Z,4,Z 0nly articles mad or 0ri ina% n on the premises shall be sold on the premises unless such articles are incidental to a permitted commercial service. Section 9.3.2.4.3 No article for sale shall be displayed so as to be visible from any street. Section Section Section Section Section Section 9.3.3 USES BY SPECIAL PERMIT: 9.3.3.3 Fire Station, Hospital, Professional Offices, Day Care Center, Old Age Home, Rest Home, Cemetery, Gift or Craft Shops and similar uses~of a public service nature~ 9.4 "R-2" MEDIUM DENSITY RESIDENCE 9.4.1 INTENT - the intent of this Ordinance in establishing a medium density residence district is to protect those residential areas within Hastings that were developed in most part prior to World War II encroachment from potential conflicting uses and to provide for future residential and related development consistent with proper existing development and with minimum standards for the provision of health, light, air and visual appeal. 9.4.2 USES PERMITTED: 9.4.2.3 Fire Station, retirement and nursing homes, professional offices, day care center, old age home, library, gift or craft shops and similar uses of a public service nature. ENFORCEMENT: SECTION SECTION 19 COMPLAINTS REGARDING VIOLATIONS Whenever a violation of this Ordinance occurs, or is alleged. to have occured, any person may file a written co~plaint. Such complaints stating fully the causes and basis thereof shall be filed with the Administrative Official. He shall record properly such complaint, immediately investigate, and take action thereon as provided by this Ordinance. 20 PENALTIES FOR VIOLATION Violation of the provisions of this Ordinance or failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with grants of variances or special exceptions) shall constitute a misdemeanor. Any person who violates this Ordinance or fails to comply with any of its requirements shall upon conviction thereof be fined not more than $300 or imprisoned for not more than 90 days, or both. Each day such violation continues shall be considered a separate offense. The owner or tenant of any building, structure, premises, or part thereof, and any architect, builder, contractor, agent, or other person who commits~ participates in, assists in, or maintains such violation mau 0una o£a separate offense and suffer the penalties herein provided. Nothing herein contained shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation, including the seeking of injunctive relief. ITEMS FOR DISCUSSION: A license will be issued at City Hall. This license will be a permanent type renewable only if there is a change in the Home OccUpation. (Section 9.3.2.4) The license fee will be five dollars~ All existing Home Occupations prior to December 31, 1970 will be accepted whether they conform or not. Home Occupations started after December 31, 1970 must meet all requirements of the Zoning Ordinance. Ail new applications must be referred to the Planning Commission and approved by the Council. Ail present Home Occupations in the City of Hastings must obtain their license during the month of or be subject to a fine. The City Administrator will maintain a current file and appropriate map depicting all Home Occupations. · No Home Occupation shall be permitted that results in the need for more than two (2) parking spaces at any given time in addition to spaces required by the occupant. All verbal complaints will be referred to the councilman from that. ward. They will investigate the situation and issue the written complaint if necessary.
