Representative Sleben presented bis views on the reasons for the ex~ra · ess[on of the legislature and the various tax bills that have been passed as to hOw they a//ect Hastings. A subcomn?ittea reported on the rezon;-ng of EaSt 4th Street. It was moved by Mr. Hallberg and seconded by Mr. Slec~.t. to._ac.c~pt the report as attached. It was moved by Mr. ~ s"~econded by to table for legal opinion as to the proper use o£ a C-3 zone. The move to table iai[ed by a vote o£ 5 to 3. The vote on the main motion passed 5 to $. The proposal for the Red Ow[ fence has been withdrawn. The Home Occupation Section of the Zoning Ordinance was referred to a subcommittee. Mr. Slebrecht, l~r. Wilson, a~d Rirs. Linde are to have a report for the next meeting. The request for a basement apartment from the l.~rsons was discusseS. They need a special use permit. It was referred to a subco~runlttee of Mr. TrautmR,,,,, Mr. Petersen, and Mr. Siebrecht. There was no report on the Sculty request for a garage. The Housing Authority was discussed. Mr. Neujahr reported to the Commls- sion the Council's act[on to table at the last meeting. Mr. Neujahi' reported that Mr. Allen Anderson wll! attend the next Council meeting to explain to the Council all of the details of an HRA and to answer any questions. The letter Iron Northern States Power regarding the addition o! 3.9.3, 3.2. to the Zo"l"g Ordi,,~,,ce (pertaining to the underground utilities) was read. It w~s tabled for discussion at the next regular meeting. The motion was made to adjourn. Ayes, all. ~$: W~LT PE~ON, eNA?~MA~, PLANNING 0~/TTEE FROM: SPECIAL cOMMITTEE, HALLBERG, NEUJAHR, SIEKIRT SUBJECT: EAST 4TH STREET ZONING PROBLEM The committee, after study, recommends: 1. ~he zone district boundaries remain as published. 2. The building permit not be issued for a lumber warehouse on the property in question. The committee took the following observations into account when deciding upon these recommendations: It was the intent of the writers of the zoning ordinance and the under- standing of the members of the planning commissiQn that a lumber retail operation shall be restricted to an I-2 zone. This intent is supported by the fact that the I-2 district boundaries include the existing lumber retail operation. It was the intent of the drafters of the zoning map to draw the boundary at the alley between hth and 5th streets to include the north half of block 32 in the I-2 zone, allowing for potential expansion of the lumber retail operation. However the official map was published with this area in the C-3 zone. It has been previously established that errors in the official zoning map are corrected by the same procedure as a request for rezoning, that is an amendment to the zoning ordinance. In doing this, issues should be opened for discussion so that all factors are again considered. It is the feeling of the commibtee that one interior lot of a block should not be rezoned. Also the area in question is in a period of transition. The previous and continuing use must be respected until the commercial and industrial development is more predictable, and proper buffers between incompatible uses is provided. The area in the vicinity of block 32 is an older part of the city. Several lots have been redesigned so the size is too small to allow reconstruction. In block 32, north half, none of the parcels are the same or the original pl~t. As the period of transition moves closer to the time when the use will be for commercial the value of the land increases but the value of the buildings decrease. Even without commercial zoning it is evident the commercial and indus- trial operations will expand into this area. The effect of this is a deterent to residential improvements. The ordinance merely guides these reactions and adds a predictable order to a natural process. The procedure of a request for a variance from the zoning ordi- nance provides a means by which an owner of residential property in a C-3 zone, can improve and maintain his property during the transition period.
