HomeMy WebLinkAbout07/12/71CITY OF HASTINGS '100 SIBLEY STREET, HASTINGS, MINNESOTA 55033 Phone 437-6921 OFFICE OF CItY ENGINEER MINUTES OF HASTINGS PLArNNING COMMISSION MEETING HELD MONDAY, JULY 12, 1971 Members present: Mr. Wait Petersen, Mr. Pat Wilson, Mr. Bob Neujahr, Mr. Frank Sieckert, Mr. Don Hallberg, Mrs. Marcella Linde, Mr. Fred Trautmann. Guests present: Mr. Joe Novak, Mr. Wallace Erickson, Mr. John Davidson, and a group of interested citizens, in particular regarding E. 4th Street zoning, relative to a building permit for Mr. Ben Sontag of Hastings Lumber Mart. The first item of business was a correction to the minutes of June Z8th, 1971. It was moved by Mrs. Linde, seconded by Mr. Neujahr that the second paragraph of the minutes be corrected to read as follows: "There was a discussion of a proposed building permit on East 4th Street" ........... It was moved by Mr. Wilson, seconded by Mrs. Linde to approve the minutes of June gSth, 1971 as corrected. There was a discussion of the 4th Street petition to withdraw the present C~3 zoning. There were two petitions submitted, one was a petition opposed to zone. (See copy of petition). Next was petition opposed to Industrial zoning for construction. (See copy of petition). The spokesman for the group was Mr. Joe Haugley. Chairman Walt Petersen reviewed the original zoning map and the present zoning map indicating what area initially was commercial and what area was expanded to commercial under the new zone. It was mentioned that the question was not whether the zone should be residential or commercial, but rather that it should be industrial or commercial. Mr. Don Lee stated that their position was to rezone back to a residential zone. Mrs. Haugley stated that several occasions the police were called in because children were playing on lumber piled on the lot and that she was informed, particularly by the City Engineer that stockpiling of open lumber on a lot was not legal storage practice. Mr. Sontag stated that the police on several occasions had checked and found it was legal storage since he was in a retail lumber operation. Mr. Haugley stated they objected to the present zone and the present proposed construction for the following reasons: Z. 3. 4. The land would be devaluated. Fire insurance premiums would be increased. They cannot add to their homes freely or at will. They are opposed to lumber piles within their residential area. M~nu~es of Hastings Plannin~ Commission Chairman Walt Petersen stated that the Study Committee would determine whether the C-3 present zone should b6 Industrial-2 and consider the petition to rezone to 2 ver ~o . Residential and turned~2commlttee of Mr. Hallberg, Mr. Neujahr and Mr. Sieckert. He stated that July 26, 1971 would be the next meeting and that the committee would make a decision by that date and Mr. Haugley will be notified. The Planning Commission Chairman read a letter from Mr. Ray Nowicki's attorney withdrawing their request for a hearing before the Planning Commission. Mr. Petersen read a letter from Mr. Dave Tanner representing Mr. Ben Sontag in regard to the warehouse. (See copy of letter attached). The next item of discussion was the Red Owl fence. The City Engineer indicated that the City Clerk had contacted the manager, Mr. Sathre and Mr. Sathre indicated that they were making an effort to have the paper removed on a daily basis. The Engineer stated he had also talked to Mr. O'Brien, their Minneapolis Office and he stated it would be impossible for Waldorf Paper Co. to pick up on a daily basis, however they would be interested in getting someone locally to do this for them. The matter for a variance for constructing a fence would be withdrawn until further notice. The question of Mobile Homes headed by Mrs. Linde's committee was referred to a later Planning Commission Meeting. Also, Chapter 409 of the Building Code in regard to mobile homes under the American National Standard Institute Code was turned over to the committee from Mr. Petersen. Mr. A1 Sieben from the audience asked about the Planning Commission's annexation procedures. He stated there was a conflict in reading the last paper, stating that the City would accept piece meal annexation whereas at the meetings he has attended in the past the policy has been opposed to that type of annexation. The City Engineer and Councilman Hallberg stated that the motion of the City Council was to take a neutral position and to accept the Municipal Commission's ruling in regard to the 40 acres of the Wallin property. Chairman Walt Petersen read a letter he had written to Mr. Kilborn in regard to the joint meeting between the Natural Resources Committee and City Council on Monday, July 19, 1971. (See copy of letter attached). He read cop[es of his letters to Bloomington, Eden Prairie, and Richfield in regard to Youth involvement. (See copy of letter attached. ) Chairman Petersen furnished each member a copy of the planned unit development ordinance. (See copy attached. ) This was handed out at the seminar which he and Mr. HaHberg attended some weeks ago. He stated that prior to codification of all City Ordinances, if there were going to be any changes, these changes should be made either in the Zoning Ordinance or by adding the planned unit development section. Minutes of Hastings Planning Commission Meeting held Monday, July 12, 1971 Page 3. Mr. Petersen read a letter written to Mr. Harry Sieben, Jr. requesting a meeting following the Legislative Session. (See copy of letter attached. ) Chairman Petersen asked if there was anyone with a definition of the Home Occupation Section of the ordinance or any corrections, changes, or alterations to make to the Hon~e Occupation Section. There being none it was deferred to the next meeting. Mr. Petersen read a letter from Hodne in regard to the Comprehensive Plan. (See copy of letter attached. ) Note: The Engineer is to mail copies of the Comprehensive Plan to the Metropolitan Council in accordance with Mr. Hodne's letter. The name of the person to receive the copy is on that letter. There was a request by the Planning Comnxission Chairman that the entire Planning Commission discuss the Vermillion River, Corps of Engineers report at their next meeting. (Gopyof report attached.) Mr. Petersen suggested that we invite Dr. Solac to discuss the MAP Program in regard to census information. This will be taken up at a later meeting. The referral from the City Council to the Planning Commission of Lots i4 thru 17, Block 4, Vermillion Addition for rezoning from R-Z to C-3 for purposes of a storage garage for Hastings Sanitary Disposal, Inc. was given to a committee of Mr. Trautmann, Mr. Petersen and Mr. Siebrecht. It was also requested that the City Engineer look into the signs on the Clark Oil Station and the Sewing Machine sign going up on gnd Street. In regard to the Sewing Machine sign the engineer stated that he was not aware of a permit being taken out. He checked into the permit and there had been none issued. There was no justification for hanging the sign. The owner or manager of the store was so notified that he was in violation of the ordinance and would be required to remove the sign and request a variance. Mr. Petersen asked Mr. Lee from KDWA Radio to relate the latest sub-committee establishment in West St. Paul. Mr. Lee stated that in the past there were no sub-committees of the Planning Commission, that all reports were heard by the total commission and they asked to have sub-committee status established. Mr. Petersen suggested a tax study committee within the Planning Commission. This will be similar to a resident or citizen's tax committee to study all phases of taxation, in particular emphasize the education part of taxation so the public does understand the function of municipal government. There was a discussion of the Elmer Pedersonproperty. The engineer related that Mr. Pederson wanted to plat by metes and bounds description a parcel of less than 5 acres and construct thereon a duplex in an Agricultural zone and the permit was denied. He also stated that he had asked Mr. Pederson to submit Minutes of Hastings Planning Commission Page 4. a plat of at least 5 acres showing what rezoning would be required for the total area, or a total comprehensive plan and further suggested that he wait until the City has secured its flood plain zoning studies. It was moved by Mr. Neujahr, seconded by Mr. Sieckert to adjourn. We completed our meeting at approximately 10:30 1°.M.
