MINUTES OF HASTINGS PLANNING COMMISSION MEETING
HELD MONDAY, JUNE 28, 1971
The Planning Commission Meeting convened at approximately 8:00 P.M. in the
Council Chambers of City Hall.
Those present:
Mr. Walt Petersen, Mr. Arland Siebrecht, Mrs.
Marcella Linde, Mr. Pred Trautmann, Mr. Pat
Wilson, Mr. Robert Neujahr.
Also present:
Mr. Robert Matsch, Mr. Ben Sontag, Mr. Wallace
Erickson, Mr. John Davidson, and a delegation of
property owners from the E. 4th Street area adjacent
to the Lumber Mart property.
The first item was the correction to the Planning Commission minutes of June 14th.
There was a motion by Mr. Neujahr, seconded by Mr. Wilson that in the procedure
for issuance of referral recommendations by the Planning Commission, under Item
No. 2, the sentence should read:
"No action be taken by the Commission on any rejected
application if the applicant fails to appear at the scheduled
hearing."
It was moved by Mr. Wilson, seconded by Mrs. Linde to accept the minutes as
corrected.
The City Engineer reviewed the building permit request from Mr. Robert Matsch
to move the Colonial Liquor Store from its 3rd Street location to 1516 Vermillion
Street. The request was made to enclose the present carport area, to provide
for sales floor space, and to use the existing enclosed structure for storage and
wine cellar operation. The Engineer advised that parking availability was not
adequate in accordance with the Zoning Ordinance at the present time, but that the
owner had proposed the driveway be extended around the building so that adequate
parking would be available upon completion. It was recommended that the building
permit be allowed, subject to adequate parking being provided and Mr. Matsch
should agree to this in writing before the building permit is issued. There being
no objection to the proposed relocation of the C-3 Use, the Engineer will make the
building permit available subject to the adequate parking being provided.
There was a proposal for a building permit on E. 4th Street, south of the present
lumber mart, the lot being owned by Mr. Ben Sontag. There was a petition sub-
mitted by local residents who were being represented by Mr. Don Lee and Mr. Gerald
(Red) King. The property owners were objecting to the rezoning of the area adjacent
to the lumber yard. The Engineer advised that there was an error in the zoning ordinance,
in that the Planning Commission had originally intended that the I-g zone be carried south

to the alley midway between 4th and 5th Street, between Tyler and Baley. The
Engineer also stated that the Planning Commission or City Council were not arbitrary
or capricious .in rezoning the areas, and were not intending to create a hardship

Use to a Commercial or Industrial Use adjacent to the present industrial-commercial
complex and because of rail availability and other factors not condusive to residentla[
living in this area. The Engineer stated that the present building permit was issued
on the basis of a C-3 zone in accordance with the Zoning Ordinance. This would
require a 10 foot rear yard setback, but no front or sideyard setbacks. However
under the I-Z Zone, it would require a 7 foot sideyard setback, and a 2 0 foot minimum
front yard setback. The building proposed however would be set 39 feet back of the
back wall of the closest home. Mr. King asked about the property lines in the area
and stated that he thought the lumber mart had already removed trees from what
was his property. The engineer indicated that in order to provide property line
locations a survey would be required. It was suggested that the property owners
present be present at the next Council Meeting on Tuesday, July 6, 1971 to make
their feelings known in regard to rezoning of their area. There was also some
discussion on the actual width of the alley between 4th and 5th Street, between Tyler
and Bailey Streets. Mr. King indicated that there were dwellings or buildings
constructed within that 20 foot platted alley. Mr. Sontag then reviewed the proposed
building, stating that he had proposed a 110 foot long by 48 foot to 50 foot width
building on another area that was zoned Industrial, however, there would be a house
within 5 feet of the property line in that case and the light and ventilation would be
shut off by construction of such a building. He stated he had purchased the property
in question some time ago with the idea that his expansion would be in that direction.
He stated that he thought the best use for the property was not for reconstruction
as residential property, but should be used for commercial or industrial purposes.
Mr. Sontag also sited that there were mining material operations being carried on
The City Street Department had a stockpile of sand and salt in the area which de-
tracted from his settings and that there were other pollution control problems be-
cause of inadquate sewer systems, etc. The City Clerk and City Engineer made
notes and will look into some of the accusations that were being made at the meeting,
in preparation for discussion before the City Council at their next regular meeting.
There was a presentation from Kermit Crouch from Hodne Partners of the Hastings
Comprehensive Plan in total. Mr. Crouch delivered 5000 copies of the Comprehensive
Plan brochure, together with several copies of the total comprehensive plan for the
City of Hastings. Mr. Crouch recommended that a public hearing be held for review
of the Comprehensive Plan and mailings be made of the Comprehensive Plan brochure
to all residents within the City prior to that hearing. It was moved by Mr. Siebrecht,
seconded by Mr. Wilson to accept the Comprehensive Plan plus the 4000 additional
brochures and unanimously passed.
It was moved by Mr. Siebrecht, seconded by Mrs. Linde to pay the balance of the
fee to I-todne Partners in accordance with the original contract.
There was a discussion of the detailed study of Hodne of specific areas. It was
suggested by Mr. Petersen that possibly the C-4 Shopping Center area which was
recommended by Hodne to be more of a Community Center than a Shopping Center
and be given a more detailed look. There was no comment from other members
of the Planning Commission.

Mr. Petersen indicated that Mr. Nowicki was proposing to petition the Municipal
Commission for annexation to the City and wanted to discuss the Mobile Home
concept for the Heschke farm south of the present corporate limits. He would
be meeting with the Planning Commission at their July 12th meeting.
The Paul Reuter request for a Car Wash adjacent to the Hastings Paint and Wail-
paper building on 18th and Vermillion was discussed. Mr. Reuter had worked
out with Hiniker Bowling Alley and adjacent property owners the location of the
building so that access could be made from T.H. 61 and exit through an easement
adjacent to the Hiniker building. A report was furnished by the subcommittee
studying this request. (See copy of Reuter Car Wash proposal attached. ) It was
moved by Mr. Wilson, seconded by Mrs. Linde to approve the subcommittee report
and recommend approval to the City Council and unanimously passed.
Following the discussion, Mr. Paul Reuter asked the City Engineer about hauling
out the debris from the old monument works when it was tore down and about the
permit. I told him a $5.00 demolition permit would be required and we would bill
him out at $6.00 per load into the landfill. He asked that he be billed directly for
the material hauled to the landfill from this demolition.
The next item of discussion was the Home Occupation Section of the Zoning Ordinance.
We do not now have permits required for home occupations. The main problem with
home occupations seems to be the parking problem in that the large number of cars
parked becomes a nuisance in residential areas and some of the residential streets
are not of sufficient width to allow parking on both sides and still allow two lanes of
traffic to pass. Two methods of limiting home occupations were mentioned. One
was the licensing method and the other was special use permit requirement in
accordance with other provisions of the Zoning Ordinance. Councilman Wi[son
stated that in one instance he knows the traffic is running down bituminous curbing
and causing a nuisance factor in the residential neighborhood, that he would recommend
some of the Fridley and Bloomington requirements being incorporated into a City
policy. Councilman Wilson asked that I not notify Councilman Collins and Council-
man Kane immediately in regard to what enforcement there is under the present
ordinance and also the question of a fee system of control, which is to be prepared
for the next regular Council Meeting for discussion.
The Planning Commission Chairman notified the Commission that the officiai hearing
on the request from Star Realty and C. A. Wallin for annexation to the City would be
held at 10:00 A.M. in the Commission Room of the Court House on August 18, 1971.
Chairman Walt Petersen read a letter from the Corps of Engineers in regard to the
Lake Rebecca turnback of the lease and the status of the development of the upper
area, Pool No. 2 - Mississippi, the responsibility of the Corps and what affects
it may have in park development for the City of Hastings.
The Chairman read a letter from the Natural Resources Committee and stated that
at the last regular Council Meeting the Safety Committee of the City Council con-
tacted the HistoricaISociety for control of the safety factors in regard to the old
Ramsey Mill. The Engineer reported that the representative from the Historical

Society had met with Mr. Christenson and would be furnishing us a written report.
The Planning Commission Chairman read a letter from a planned unit development
seminar stating that an assistance kit had been forwarded to Mr. Hallberg for
Planned Unit Development Use. There will be more discussion on this matter at
a later date.
The Chairman briefly reviewed the status of the Mobile Home Legislation and
stated that there were two bills affecting Mobile Home construction and taxation
and outlined some of the information he had received in regard to tbs Lakeville
Mobile Home tax report. Copies of this were made available to Mr. Petersen.
In regard to relocation of the Court House the engineer reported that the Commissioner,
Gary Pagel had contacted him in regard to the status of Pleasant Drive. The engineer
reported that this would be a north-south thoroughfare from CSAH 47 to CSAH 42.
The County Board Committee under the direction of Mr. Pagel were considering
movement of the Court House easterly to Pleasant Drive so that off-highway access
would be immediately available. Mr. Wi[son brought up the matter of sector studies
in regard to the City planning program and suggested that the shopping center area
on T.H. 55 be looked into.
The Engineer reported on a request by Mr. Elmer Petersen to construct multiple
dwelling units on County Road No. 54 within the corporate limits. It was generally
decided that until the flood plain study was secured from the Corps of Engineers and
a total Comprehensive Plan of this area was submitted, no building permits should
be issued in this area.
The Red Owl fence was tabled due to lack of the study committee being present.
We completed our meeting at approximately 10:30 p.M.

Relocate per sketch.
Fence south edge of structure to blend with entrance
and exit.
Close Vermillion Street center island.
Relocate curb openings if necessary subject to
Minnesota Highway Department approval.
Submit a topographic map showing present and
proposed conditions.
Adhere to all sections of the Zoning Ordinance
pertaining to service stations.
Fencing subject to approval of adjacent property
owners and as recommended by the City Engineer.
