MINUTES OF HASTINGS PLANNING COMMISSION MI~,~TING
HELD MONDAY, JUNE 14, 1971
Those present:
Mr. Wait Petersen, Mr. Arland Siebrecht, Mr. Don
Hallberg, Mr. Pat Wilson, Mr. Bob Neujahr and
Mrs. Marcella Linde.
Also present:
Mrs. Neujahr, Mr. Larry Yanz, Mr. Dick Collins,
Mr. John Davidson and members of the press.
It was moved by Mr. Sieckert, seconded by Mr. Wilson and unanimously
passed to accept the minutes as written for the meeting of May 24, 197t.
It was moved by Mr. Neujahr, seconded by Mr. Hallberg to remove the
motion outlining the procedure for issuance of permits from the table and
unanimously passed. There was a discussion of the motion as written.
(See copy of motion as amended. ) The title should be altered to read "l~ro-
cedure for Issuance of Recommendations by Planning Commission". Add
to paragraph at the bottom of the page: "Failure to appear within 45 days will
be considered grounds for withdrawal of said application." (Note: Procedure
for issuance of permits shall be attached to the outlined for "Special Use
Permits" and "Variances". ) It was moved by Mr. Neujahr, seconded by
Mr. Sieckert and unanimously passed to accept the Resolution as amended.
The next item of discussion was a request by Industrial Builders, Inc. for an
expansion to the Bierstube. Mr. Larry Yanz was present to testify in favor of
the expansion. Mr. Neujahr pointed out that under Section 6.4. 1, "No non-
conforming structure may be enlarged or altered in any way which increases
its non-conformity, but any structure orporfion thereof may be altered to de-
crease its non-conformity". In Mr. Neujahr's opinion, the non-conformity
which presently exists in regard to shopping center parking facilities would
not be improved by the allowance for the extension of the Bierstube Building
closer to Eddy Street right-of-way. It was moved by Mr. Hallberg, seconded
by Mr. Sieckert and unanimously approved to refer the Bierstube proposal and
Red Owl proposal for solid waste storage to a sub-committee of Mr. Sieckert,
Mr. Hallberg and Mrs. Linde to meet with the owners.
It was moved by Mr. Neujahr, seconded by Mr. Wilson and unanimously passed
that the City Engineer receive a letter from the Chief of l~olice and Fire Chfef
and forward information in regard to total traffic, safety and fire requirements
along Eddy Street, [ncluding the following:

An Analysis of Midtown Shopping Center with regard to the
degree of its conformity or non-conformity to the Zoning
Ordinance of the City of Hastings adopted December 31, 1970.

Study related problems as to traffic flow and public safety as
they now exist and how they would be effected upon approval
of any or all requests before the Planning Commission.
Copies of the above report are to be furnished to the Study Committee and all
members of the Planning Commission.
Mr. Walt Petersen then informed the Planning Commission that the Hy-de-Hy
request for re-zoning had passed the first reading at the last regular Council
Meeting. It was moved by Mr. Siebrecht, seconded by Mrs. Linde that we restate
our feelings to the City Council in regard to the denial of the Hy-de-Hy proposal
in regard to good City Planning and according to the Comprehensive Plan whereby
it was made known that no additions of this type be granted. Ayes 6; Nays 1.
The City Engineer stated that on June 23, 1971 at 8:00 P.M., the Vermillion
River Study Committee would be meeting with the Corps of Engineers to discuss
the altered plan for the Vermillion River flood protection project. (Make a
note to send out a notice to all members of the Vermillion River Study Committee,
this is not the Natural Resources Committee, but a committee made up of three
Councilmen, three Planning Commission members and three citizen members. )
It was moved by Mr. Neujahr, seconded by Mr. Siebrecht and unanimously passed
to refer a letter from the Natural Resources Committee in regard to the ruins
at the Old Mil1 Park be turned over to the City Council for referral to the Safety
Committee and that it deals with public safety.
The next item of discussion was the Paul Reuter Car Wash Facility. The Engineer
related the changes that Mr. Reuter wanted to make to the facility to change the
traffic patterns. This was referred to a committee of Mr. Wilson, Mr. Neujahr
and Mr. Bauer.
Mr. Petersen reported on the League of Municipalities Meeting and stated that
the State Legislature had taken action on Mobile Homes dur.ing the regular session,
Chapter 797 dealing with taxation changes and Chapter 559 dealing with Mobile
Home Building Codes. The entire Mobile Home proposal should be referred back
to a study committee for recommendation to the full commission. The committee
consists of Mr. Wilson, Mr. HaHberg, Mr. Sieckert and Mrs. Linde. Mrs. Linde
will be acting chairman.
The Engineer reported that Kermit Crouch could not make the June 14th meeting.
He would however, be available for the June 28th meeting. (Please notify Mr. Crouch
of the June 28th meeting, so he might be in attendance.
The Engineer reviewed the County Road system and suggested changes by the Dakota

County lEng[neers Association for construction funding. The Engineer related that
we were not taking a position in regard to the turn-back of 35% of the first 14 mils,
but were merely pointing out the need for revision in the policy for construction
funding different from the 45/municipal funds, 55%/county funds for all highway
or system construction and 0% participation by townships in regard to township
road construction.
Mr. Petersen discussed the ¥o~zth in Government Program and asked that this be
given some consideration for more discussion at the June ZSth Meeting. Mr. Trautmann
was appointed the coordinator in regard to the County Highway System and proposed
change s.
Councilman Hallberg referred to Section 16 of the Zoning Ordinance and suggested
that some fees are necessary under the new Zoning Ordinances. He stated he would
prepare a resolution for the next Planning Commission Meeting of June 21, 1971.
It was moved to adjourn and unanimously passed. The meeting was completed at
approximately 10:00 P. M.
The following items were brought up by Councilman Wilson following the meeting:
The picnic tables .in the Lake Rebecca Park area need painting.
He asked Lf the NYC Progran~ might take care of this.
They need more trash cans in the Lake Rebecca Park. He
stated that at the end of July there would be a 3M picnic [n the
Roadside Park of about 350 persons and wanted to know if
additional tables might be moved to that area for the day. He
will be seeking information on this at a later date.

PROOEDURE FOR ISSUANCE OF REFERRAL RECOMMENDATIONS
BY PLANNING COMMISSION
WHEREAS:
the rejection of applications and permits by the Planning
Commission often occur with the applicant not present,
and '
WHEREAS: This can often lead to mlsunders~anding and/or lack of
communication for both parties, and
WHEREAS: Specific concrete steps should be taken to avoid continuance
of this situation;
BE IT RESOLVED: That the Hastings Planning Commission establish
the following procedure:
Any study committee recommendation or Planning
Commission action to reject appt~cat[ons and permits
be preceded by a three (3) day written notification to
the applicant requesting his appearance at the Commission
Meeting which is to take up his request.
No action be taken by the Commission on any application
if the applicant fails to appear at the scheduled hearing.
Failure to appear within 45 days will be considered grounds
for withdrawal of said application.
