A review of the Imperial Estates Gaspere-Dockmo proposal. Mr. J. Pallor from Harry S. Johnson reviewed the layout with the Chairman of the Sub- Committee, Mr. Wilson. It was pointed out that there was not enough area to support the proposed Z52 units that would allow for only 247 units. There- fore it was recommended by Mr. Pallot that the units would be ultimately be six 36-plexes and 1 - 30-unit which would be a decrease of 6 units rather than the necessary 5. Also that the offset from the property line to any structure such as garages would be a minimum of 8 feet and that adequate drainage would be provided through the facility. There was a review of the request from Mr. Larry Yanz, ov, mer of the Bierstube for a 9' 6" x 20' addition to his building at Eddy and T.H. 55. This request had previously been denied by the Planning Commission and recommended for denial to the City Council. The Engineer reviewed the studies in regard to site distance lost by extension of the building wing to the west as proposed. Mr. Yanz said that he had appeared before the Council in an unoffical capacity, since he felt he had not been giyen a chance to speak on his own behalf in regard to expansion of the Bierstube, he stated that he has a problem because of space limitation at the present time and would request the Planning Commission reconsider their decision to deny the request. Councilman Paul Kane stated that he had talked with other owners in the Shopping Center, ali of whom stated because of loading facilities on Eddy Street they couldnot expand their properties. Part of the concern in the denial was that this would set a precidence and that other stores in the areas may also wish to expand 10' to their property line along Eddy St. It was pointed out that the 10' to the property line would still leave a 17' boulevard to the 32' travelled street. At 8:05 P.M. there was a quorum. Those present were: Mr. WaNt Petersen, Mrs. Marcella Linde, Mr. Frank Sieckert, Mr. Pat Wilson and Mr. Don Hallberg, Fred Trautmann Also present were City Engineer John Davidson, City Clerk Wallace Erickson, Councilmen Kane, Christenson and Mayor Rotty. The first official item on the agenda was to approve the minutes of April 1Z, 1971, with the following co r rections: Minutes of Hastings Planning Commission Meeting held Monday, April Z6, 1971 Page 2. The date should be changed from March 12, 1971 to April 12, 1971. Also those present should list the name of Mr. Sieckert and Mr. Wilson who came late to the meeting. Minutes were approved as corrected upon motion by Mr. Sieckert, seconded by Mr. Wilson. There was a request from Minnesota Federal to construct a time and temperature sign over street right-of-way. Mr. Fred Trautmann presented the sub-committee report and stated that he recommended the approval based on the new sign de- creasing the overhang from the present sign and that the approval was also based on the public service facility of the sign stating the time and temperature. The Variance requested is under Section 7. 3. 6 in regard to signs over public right- of-way and Section 7. 3.20. 5 stating that a sign must be 10 feet from street right- of-ways. Mr. Hallberg stated that there was an effort in the downtown area to create a new appearance and asked if the owners of the Minnesota Federal Building were aware of this program and had taken this into account in making their request for a variance. Mr. O'Neill stated that he does not know what the downtown plan is and has not taken part in the downtown planning to date. It was moved to approve the subcommittee report and make recommendation to the City Council for approval. Vote as follows: Ayes; Mr. Wilson, Mrs. Linde, Mr. Trautmann, Mr. Peterson; Nayes; Mr. Hallberg and Mr. Sieckert. The next item of discussion was a report by Mr. Wilson on the subcommittee investigation of the Gaspere-Dockmo proposal and stated that there was a deficiency in area to allowthe 252 units, that it could support only 247 and stated that the garages would have to be completed with stage construction so that there would be one garage for each two units as they are built. Mr. Wilson moved to approve the subcommittee report recommending the approval subject to the 247 unit limitation and the stage construction in compliance to all sections of the Zoning Ordinance. Mr. Hallberg seconded the motion. Vote: Approval of a planned unit development permit to Gaspere-Dockmo; Ayes; Mr. Wilson, Mr. Hallberg, Mr. Sieckert, Mrs. Linde, Mr. Trautmann, Mr. Petersen; Nays, none. Next was a recommendation to table the request from the Eagles for the Shooting Range. Mr. Sieckert reported on the Donald Carl request for conversion of a single-family dwelling to a basement apartment unit. This would be a Special Use Permit request under Section 9.4.2.4.2 of the Zoning Ordinance - Conversion to a Multiple /Dwelling Unit. It was moved by Mr. Sieckert, seconded by Mr. Hallberg to recommend approval subject to compliance to ali building code requirements and the vote was as follows: Ayes; Mr. Wilson, Mr. Hallberg, Mr. Sieckert, Mrs. Linde, Mr. Trautmann, Mr. Petersen; Nays, none. The next item of discussion was the Siewert annexation. This was tabled. Minutes of Hastings Planning Commission Meeting held Monday, April 26, 1971 .Page .t. There was a request from the Viking Bottling Company to use the Hy-de-Hy Building for a retail sales. It was moved by Mr. Wilson, seconded by Mr. Sieckert and unanimously passed to reject the commercial use of the Industrial property. Mr. Wa[lens[on asked what right of appeal he had. The City Attorney stated that he could appeal to the City Council and his attorney had been so advised. (See copy of letter from Mr. Jeffrey J. Wallenston, Manager, attached.) Mr. Mackey, present in attendance, asked what decisions had been made on Trailer Parks. The Planning Commission Chairman answered his question by stating that the Planning Commission is awaiting a final report from the sub- committee who is studying these mobite home park developments and in the interim they are waiting for the Legislative action which would change the tax base in a mobDe home park. The Engineer advised the Planning Commission and Council members present that prints were made of the proposed development of the Lake Rebecca area that were furnished by the Corps of Engineers at the meeting of April 22, 1971 and if anyone wished copies of the prints, to advise the Engineer, that he was sending the tracings back to Mr. Langer of the Corps of Engineers Office. (The only one requesting prints was Mr. Prank Sieckert). The other set of prints will be filed in the Planning Commission file. Mr. Petersen advised that the Chairman of the Open Space Committee, Mr. Dave Pederson, recommended that the interior driveway and roadways within the Mill Park be eliminated and that only pedestrian traffic be allowed internally within the park, and adequate off-street parking facilities be located adjacent to the road accesses. There was a request to rep[ace the swing seats at the Dakota Hills Park. (Make a note of this and check with Don Louden to make sure we have seats on all of the swings that are presently in ptace.) The members of the Council present for the Joint Meeting were: Mr. Christenson, Mayor Rotty and City Attorney Don Fiuegel They met with the Planning Commission. The meeting was chaired by Council- man Hallberg, chairman of the Planning Committee of the City Council. He stated that the subjects for discussion jointly between the City Gouncii and Planning Commission and Natural Resources Committee would be as follows: 1. Annexation 2. Mobile Home Parks 3. Long range objectives which would deal with: a. Parks b. Open Space c. Lake Rebecca 4. Industrial Park Minutes of Hastings l~lanning Commission Meeting of April Z6, 1971 Page The first item of discussion was the Industrial Park. The City ]Engineer related what actions have taken place to date, the fact that the land is being appraised and contracts have been awarde8 for construction of utilities to the area. There is some concern on the part of Marshan Township in up- grading 160thStreet and the access road between T.H. 316 and T.H. 61 as a 9-ton access to T.H. 61 and ultimately to the T.H. 55 by-pass. Also some alternatives were discussed in this regard. At this point, Mr. Gunnar Insberg, the County Planner arrived at the meeting. Mr. Tony Willeke representing the Natural Resources Committee gave a report on what the Natural Resources Committee have done to date. He stated they are presently gathering information and this statistic information will be available to the Planning Commission and City Council following the tabulation of the data received in the Natural Resources Committee Questionnaires being circulated. He stated that the number one priority as far as Natural Resources was concerned was the Vermillion River Watershed because of the concern of the Corps of Engineers over the possibility of flood damage because of the natural resources in the area and have recommended that the entire area along either side of the Vermillion River through Hastings would be purchased for a parkway and that all of the flood plain from the Vermillion River to approximately the retired railroad right-of-way in South Hastings be acquired as well as the right-of-way along GSAH 47 and the Vermillion River. They are awaiting the Flood Plain Study from the Corps of Engineers which should be available to the City sometime in June or July of 1971. They are also recommending that the entire Hagen farm in South Hastings be purchased and that this area would be used for a picnic area, trails and scenic overlook at the Peavey Falls. They have also been advised by the Historical Society that they would rebuild the Ramsey Mill ruins, not to rebuild the mill, but to reconstruct the ruins so they would be safe. It was also stated that they have met with the Corps of Engineers and suggested a alternate proposal as far as flood prevention is concerned by constructing a by-pass overflow channel and a tunnel system under T.H. 61 to increase the hydraulic opening at T.H. 61. He stated that in some area under the 100 year flood plain frequency was going to have to be preserved. They are requesting purchase of 80 acres of flood plain plus an additional 30 to 40 acres for park purposes. He stated that they are presently studying the Lake Isabelle and Lake Rebecca areas, however, no detailed studies have been made to date. The next item of discussion was annexation, in particular the 40 acres requested by Mr. C. A. Wallin and Mr. Neal Siewert of Star Realty Company. The request was based on the fact that the area between Pleasant Drive and the west corporate limits was too short for a series of east-west streets and in order to develop this into a cUrvilinear platting, an additional area outside of the present corp- orate limits is required. The Township of Nininger have formally objected to the annexation to the Municipal Commission. The next scheduled action would be a hearing before the Municipal Commission and the City Attorney advised that he had discussed this with the Attorney for the Municipal Commission and suggested a delay until the meetings between the City and Townships have been completed so there was a concensus of opinion prior to holding any bearings. Mr. Gunnar Isberg reviewed the several possibilities for annexation, incorporation, or consolidation. Minutes of Hastings Planning Commission Meeting held Monday, April 26, 1971 l~age 5. There was a general discussion about ali phases of annexation in Hastings. It was pointed out that the differences in the Nininger Township case versus the Marshan Township that if in fact the property were annexed to the T.H. 55 by-pass, that this would leave very little area within the Nininger Township area which would be controlled by the Township form of government and the possibility that the Municipal Commission would suggest annexation of all of Nininger Township. Mr. Isberg also reviewed the possibility of tax break laws in setting aside a definite rural, farm, or agricultural uses, which would not be taxed at the same rate as the urbanized portion of the municipality. At 10:30 1o.M. Mr. Gunnar Isberg had to leave. The meeting continued with a discussion of Mobile Homes. Mr. l~etersen reviewed the four proposals before the i°lanning Commission. It was suggested that no action be taken jointly by the l~lanning Commission and City Council until the Legislative action from this session was known.
