<br />Hastings City Council Minutes <br />May 19, 2003 <br />Page Three <br /> <br />Public Hearing: Vacation of Alley and Right-of-Way #2003-35; 500 2ND Street West- <br />Rick Ries <br /> <br />Mayor Werner opened the public hearing at 7:23 PM, and Planning Director John <br />Hinzman presented information on the proposed vacations of the alley and Right-of- <br />Way of Forest Street. Planning Director advised that a letter had been submitted by the <br />neighbors expressing opposition to the proposed vacations. Rick Ries, the applicant <br />addressed the City Council on the reasons for his request of the vacations. Jackie <br />Boler, 402 W. 7th Street presented comments on the need to retain alleys in the City. <br />Mayor Werner closed the public hearing at 7:34 PM <br /> <br />Moved by Councilmember Hicks, seconded by Councilmember Moratzka to <br />approve Resolution No. 5/11/03, denying the vacation of the alley and right-of-way of <br />Forest Street, based on the following findings of facts: <br /> <br />1.) <br />2.) <br />3.) <br />4.) <br /> <br />Loss of access to a public water. <br />Loss of access to adjacent City property behind the alley. <br />Vacation of alleys and rights-of-way are discouraged under the Downtown <br />Master Plan. <br />Existence of City utilities in the Forest Street right-of-way <br /> <br />Ayes: Mayor Werner, Councilmembers Hicks, Moratzka, Riveness and Hazlet <br />Nays: Councilmember Yandrasits <br /> <br />Public Hearing: Vacation of Easement (Trail) South Pines 5th Addition <br /> <br />Mayor Werner opened the public hearing at 7:45 PM, and Planning Director John <br />Hinzman presented information on the proposed trail easement vacation. No one <br />spoke at the public hearing, and Mayor Werner closed the public hearing at 7:46 PM. <br /> <br />Moved by Councilmember Yandrasits, seconded by Councilmember Riveness to <br />A~prove a Resolution authorizing the vacation of the trail easement in the South Pines <br />st Addition. <br /> <br />Ayes: Councilmembers Yandrasits, Riveness and Hicks <br />Nays: Mayor Werner, Councilmembers Moaratzka and Hazlet <br /> <br />The Resolution is not approved. <br />
