<br />Declaration. <br /> <br />B. Maintenance ofoondim! basin within the Subiect Prooertv. Developer, its <br /> <br />successors and assigns on the Subject Property shall be responsible for all <br /> <br />maintenance costs associated with the ponding basin located within the <br /> <br />Subject Property. Developer may assign this maintenance obligation to a <br /> <br />property owners association for the Subject Property. This ponding basin <br /> <br />shall be maintained in accordance with the requirements of the City and shall <br /> <br />include the obligation to provide for any erosion control f any open swales or <br /> <br />ditches. <br /> <br />9. Three Unit Buildin1!s. Any buildings constructed on the Subject Property which <br /> <br />consist of three or more units must receive site plan approval by the Hastings <br /> <br />Planning Commission and the Hastings City Council prior to their construction. No <br /> <br />building permits for any such buildings will be issued until these approvals have been <br />obtained. <br /> <br /> <br />10. Gradin1!. Draina1!e and Utility Plans. No construction or grading of any type shall <br /> <br /> <br />take place on the Subject Property until Developer has received final approval from <br /> <br /> <br />the City's Public Works Director for Developer's grading, drainage and utility plans. <br /> <br />Furthermore, no construction shall take place until Developer has reimbursed the <br /> <br />City for all fees incurred by the City in reviewing Developer's grading, drainage and <br /> <br />5 <br />
