<br />Subd 6. "Review of Permits" changed to "Certificate of Approval." Under <br />the existing ordinance the Building Department refers building permits <br />to the HPC. The HPC found that owners had often signed contractors <br />and purchased materials before coming in for a Building Permit. <br /> <br />The amendment requires that all exterior changes to sites be reviewed <br />and a Certificate of Approval be issued before they are made. The <br />Certificate is needed before a building or sign permit can be released. <br /> <br />The amendment replaces criteria for review included in the 1985 <br />ordinance with direction to use the Design Guidelines adopted by the <br />HPC and the Secretary of Interior's Standards of Rehabilitation in <br />reviewing applications. The Guidelines are very complete, illustrated, <br />well organized and have proven workable. The Standards are general <br />principals recognized nationally. The Guidelines and Standards are sent <br />to the designated historic site owners and are on the City web site. <br /> <br />The amendment provides for public hearings when substantial changes <br />of appearances or demolition would impact the neighbors. <br /> <br />Subd. 6. E. 1. f. Appeal to City Council. An owner's appeal of an HPC <br />decision, on grounds of economic hardship, will be considered by the <br />City Council rather than the HPC. A draft Council procedure is <br />attached. <br /> <br />Subd. 7. Enforcement. The amendment authorizes enforcement by the <br />Department of Building Safety. The Heritage Preservation Staff would <br />provide the specifics of the violation to the Building Official and work <br />with the City Attorney after notification of violation. <br /> <br />Action <br /> <br />If Council is satisfied with the language, adopt the proposed amendment. <br /> <br />Appeal Procedures <br /> <br />The draft council procedures for appeals should be considered <br />separately.
