That the Developer shall pay the required per residential interceptor sewer fee prior to release of <br />final plat hardshells; <br />That approval the preliminary plat and any final plat shall be subject to park/public land <br />dedication requirements as recommended by the City of Hastings Natural Resources and <br />Recreation Commission and approved by the Hastings City Council. <br />The developer shall plant 10 trees at least two inches in diameter as indicated on the landscape <br />plan. <br />That the Developer shall modify the final plat to identify property 30 ft west of the centerline of <br />Eddy St as right of way (ROW). <br />The Developer shall enter into a development agreement with the City of Hastings Documenting <br />conditions of approval for K + K addition. The Development agreement shall be signed prior to <br />the City releasing the final plat hard shells. <br /> <br />Upon vote taken, Ayes, 2; Nays, 3. Motion did not carry. (Non recommendation) <br /> <br />City Planner, Matthew Weiland advised the Planning Commission to come up with another <br />recommendation. <br /> <br />Commissioner Anderson made a motion and Commissioner Donndelinger made a second to <br />recommend denial of the K + K Addition preliminary plat to the City Council subject to the <br />following conditions: <br /> <br />Insufficient greenspace in the project. <br />Storm water runoff problem. <br />Not compatible with the neighborhood <br /> <br />Upon vote taken, Ayes,4; Nays, 1. Motion carries. <br /> <br />Site Plan <br /> <br />Planning Commission Discussion: The Planning Commission discussed approving the site plan with a <br />smaller road, a smaller garage, and 4 units. <br /> <br />Planning Commission Action: <br /> <br />Commissioner Schultz made a motion and Commissioner Flom made a second to recommend <br />approval of the K + K Addition Site Plan to the City Council subject to the following conditions: <br /> <br />1. The proposed structure and accessory items including, but not limited to streets, utilities and <br /> landscaping shall be completed pursuant to the approved site plan. Upon request for occupancy of the <br /> building, all uncompleted items contained within the site plan shall be addressed pursuant to city code <br /> escrow requirements. <br />2. The applicants shall modify the site plan to identify a no parking area in front of the proposed garage. <br />3. The applicants shall obtain a drainage and utility easement in the southwest corner of the western <br /> property owners lot to be recorded with the development agreement. <br />4. The applicants shall enter into a development agreement with the City of Hastings. <br />5. Modify the site plan to illustrate a smaller 20 x 24 fl garage. <br />6. Modify the site plan to illustrate a 20 fl wide road. <br />7. Modify the site plan to only include 4 units. <br /> <br />Upon vote taken, Ayes,5; Nays, 0. Motion Carried. <br /> <br />4.
