<br />Riverfront Addition #2005-28 - Preliminary & Final Plat, Site Plan, SUP <br />City Council Memo - May 16, 2005 <br />Page 6 <br /> <br />Shoreland Provision <br />Chapter 16, Section 16.05, Subd 5.2A of the City Code, Special Uses in the DC - <br />Downtown Core Zoning, allows impervious surface coverages to exceed 75 percent in the <br />DC Zoning District upon Special Use Permit approval, subject to the following: <br /> <br />a) All applicable provisions of Chapter 15, Stormwater Management of the <br />City Code of Ordinances. <br /> <br />b) All structures and treatments shall be installed for the treatment of <br />stormwater runoff in accordance with the City of Hastings Watershed <br />Management Plan. <br /> <br />c) Improvements that will result in an increased rate of runoff directly <br />entering a public water shall have all structures and practices in <br />compliance with the City Storm Water Management Ordinance in place for <br />the collection and treatment of storm water runoff or will be constructed in <br />conjunction with a special use permit application. <br /> <br />" <br /> <br />d) The lot shall be served by municipal sewer and water. <br /> <br />e) Storm water is collected and treated in compliance with the City Storm <br />water Management Ordinance and Best Management Practices. Such <br />treatment may be comprised of either on-site control, access to the City's <br />storm water control system, or a combination of both, to be approved by <br />the City Engineer. <br /> <br />* Provisions in italics are part of an amendment to the Shoreland Ordinance provisions. <br />The Planning Commission recommended approval of the changes. The City Council <br />has considered first reading and is scheduled to act on the amendment at the May 16, <br />2005 Meeting. <br /> <br />Definition <br />The Zoning Code defines and regulates special uses as follows: <br /> <br />Uses that would not be appropriate generally or without restriction throughout the zoning <br />district but, if controlled as to number, area, location, or relation to the neighborhood, would <br />not detract from the public health, safety, and welfare. Special uses may be permitted in a <br />zoning district if specific provision of such special uses is made in this Zoning Ordinance. <br /> <br />.
