FINAL PLAT - <br />CARI PARK 3RD ADD. <br /> <br />16. <br /> <br />17. <br /> <br />That a development agreement be entered <br />into to take into considerations and <br />understandings mentioned above or those <br />that may be recognized at a later date. <br /> <br />That the Developer must comply with <br />recommendations of the Dakota County Soil <br />and Water Conservation District to ensure <br />compliance with requirements of the <br />Wetlands Act of 1991. <br /> <br />Upon vote taken, Ayes, 6; Nays, 0. <br /> <br />Commissioner Bolesworth moved, Commissioner <br />Bateman made a second, to recommend approval <br />of the Riverwood Townhomes No. 3., Site Plan <br />subjection the following condition: <br /> <br />That the construction of the townhomes <br />and related site plan improvements shall <br />be completed as per the approved site <br />plan. Occupancy of the townhome units <br />shall not take place until all site plan <br />related improvements have been completed. <br />In the alternative, occupancy of the <br />units may be permitted if the developer <br />provides the city, as per city code <br />requirements, a cash escrow in the amount <br />equal to 125% of the cost of the site <br />improvements remaining to be completed. <br /> <br />Upon vote taken, Ayes, 6; Nay, 0. <br /> <br />Commissioner Featherstone moved, Commissioner <br />Mesaros made a second, to recommend approval <br />of the Cari Park 3rd Addition Final Plat <br />subject to the following conditions: <br /> <br />Requirement that the Cari Park <br />Development Agreement be amended to <br />permit the proposed twinhome development <br />and that requirements for design and <br />construction of necessary public <br />improvements be specified in the <br />agreement. <br /> <br />Payment of $7200.00 cash in lieu of land <br />for park dedication prior to release by <br />the city of the final plat. <br /> <br />Street tree plantings shall be installed <br />per City Code requirements. <br /> <br /> <br />
