10. <br /> <br />Upon <br /> <br />Requirement that the proposed Outlot A be <br />legally conublned with Lot 12, Block 1 of <br />Cari Park. <br /> <br />That a north/south pedestrian trail <br />easement be dedicated by the Developer <br />(by separate document) along the east 20 <br />feet of Lot 12, Block 1, Cari Park Third <br />Addition to provide pedestrian access for <br />residents of Cari Park to the County <br />Crossroads Shopping Center. Further, the <br />Developer shall install a bituminous <br />pedestrian trail constructed to City <br />standards within the easement. <br /> <br />That the developer understand and agree <br />that the cul de sac on Cari Park Lane may <br />be extended to the south as a through <br />street to 36th Street. <br /> <br />That a benchmark elevation be established <br />on the plat. <br /> <br />That no fences or other non-vegetative <br />structures be allowed within the <br />pedestrian easement. <br /> <br />Prior to any Certificates of Occupancy <br />being issued for Cari Park 3rd Addition, <br />the developer shall provide a copy of the <br />Deed Covenants which state that the <br />homeowner shall share responsibility for <br />maintaining all utility lines in Cari <br />Park 3rd Addition. <br /> <br />That a development agreement be entered <br />into to take into consideration the <br />conditions and understandings mentioned <br />above and those that may be recognized at <br />a later date. <br /> <br />vote taken, Ayes, 6; Nay, 0. <br /> <br /> <br />
