PUBLIC HEARING- <br />ZONING TEXT <br />AMENDMENT-SEC. <br />10.10-JUDGE <br /> <br />There is a defacto alignment of houses established, the <br />proposed siting complies with this alignment. <br /> <br />To enforce the setback would deprive the applicant of <br />future revenues if forced to sell and more importantly <br />reduce the value of adjacent owners. <br /> <br />Upon vote taken, Ayes, 4; Nays, 1 (Mesaros). <br /> <br />Czech reviewed staffs June 11, 1992, memorandum to the <br />Planning Commission concerning a request by Jim Judge <br />of Judge Electric for approval of an amendment to <br />Chapter 10, Section 10.10 of the Hastings City Code which <br />would allow electrical contracting and other similar uses in the <br />Agricultural (A) District. <br /> <br />Commissioner Mesaros opened the public hearing at 7:47 p.m. <br />There being no comments from the audience, the public <br />hearing was closed. <br /> <br />The Planning Commission discussed issues relating to the <br />proposed text amendment including, but not limited to, whether <br />other zone districts could accommodate this type of use and <br />whether the Agricultural District was appropriate for this type <br />of use. Jim Judge the applicant for this request was present at <br />the meeting and answered questions presented by the Planning <br />Commission. <br /> <br />Commissioner Featherstone moved, Commissioner Bolesworth <br />made a second, to deny an amendment to Chapter 10, Section <br />10.10 which would allow electrical contracting and other similar <br />uses based on the following findings: <br /> <br />Electrical contracting and other similar uses would be in <br />appropriate and inconsistent in the Agricultural District. <br /> <br />The intent of the Agricultural District is to "allow <br />maximum freedom of operation for Agricultural <br />purposes and to protect such uses from untimely <br />encroachment of potential conflicting urban uses. It is <br />also the intent to protect the natural amenities of <br />Hastings from the harmful exploitation. Furthermore, <br />the Agricultural designation is used by the City for any <br />land which may be annexed to the City until special <br />action of the Council is taken to assign another land use <br />district". <br /> <br /> <br />
