-2- <br /> <br />Drive be considered as future state aid collector streets <br />meeting state aid design standards, that the developers <br />provide restrictive covenants requiring at a minimum the <br />landscaping shown on the typical site plan drawing re- <br />viewed by the Planning Commission, as well as other struc- <br />tural standards, and that these conditions be set forth <br />in a development contract between the City and the de- <br />velopers. 7 Ayes, 0 Nayes. <br /> <br /> Chairman Murphy opened the Public Hearing at 7:36 P.M. <br />The Planner informed the Commission that on file were <br />copies of the Notice of Public Hearing, Affidavit of <br />Publication, and Certificate of Mailing. Thus, the Public <br />Hearing was properly called. The Planner went on to <br />summarize the Staff Report, and indicate that at least <br />one citizen had expressed concern about assuring the <br />drainage would not affect the property to the North, that <br />the drainage plan be required to be adhered to, and that <br />the property at the corner of 4th & Ash Street be better <br />maintained. <br /> <br /> Commissioners Wendler and Conzemius asked questions <br />about where the drainage was proposed to go in and around <br />the development. Commissioner Wendler also asked if <br />there were any houses on 4th Street with walkout base- <br />ments. Mr. Sieben, the developer, indicated that there <br />was storm sewer in the former Farm Street r~ght-of-way, <br />that drainage followed along the rear property lines, <br />and that there were no walkout basements on the~South <br />side of 4th Street. Commissioners Stevens and Wendler <br />indicated that the rules governing the distance between <br />buildings, and the required recreation facilities be <br />clarified in the future. After all people present had <br />an opportunity to be heard on the matter, Chairman Murphy <br />closed the Public Hearing at 7:48 P.M. <br /> <br /> Moved by Commissioner Swanson, seconded by Commis- <br />sioner Wendler to recommend approval of the special use <br />permit, the PRD permit, the five acre PRD size variance, <br />and the front parking lot setback variance, based upon <br />and conditioned upon the information contained in the <br />February 25th, and March llth Staff Reports. It is the <br />intent that the condition referring to additional drain- <br />age detail be provided before the Council makes their <br />final decision on this matter. 7 Ayes, 0 Nayes. <br /> <br /> Commissioner Stevens suggested that the Commission <br />review the developed open space, the building distance, <br />and the five acre minimum aspects of the PRD regulations. <br />Commissioner Murphy appointed a Committee Chaired by <br />Commissioner Wendler, and including Commissioners Stevens <br />and Reuter to look into the matter and report back at <br />the next meeting. <br /> <br />PUBLIC HEARING - <br />SPECIAL USE PERMIT AND <br />VARIANCES - BIRCHWOOD <br />TOWNHOMES PRD - 5TH <br />& ASH STREETS - AL <br />SIEBEN <br /> <br /> <br />
